Transparency

Definition

A foundational data protection principle requiring organizations to provide clear, accessible, and comprehensive information about how they collect, use, share, and protect personal data, enabling informed decision-making and accountability. Under GDPR Article 5(1)(a), processing must be 'lawful, fair and transparent,' and transparency obligations appear throughout the regulation in notice requirements (Articles 13-14), rights information (Article 15), and accountability (Article 5(2)). Effective transparency involves: providing information at collection time, using clear and plain language avoiding legalese, making information easily accessible, layering information from high-level summaries to detailed policies, actively communicating rather than passively posting, and updating information when practices change. Organizations should: publish privacy policies in prominent locations, provide just-in-time notices at data collection, use icons or visualizations for key points, offer multiple languages when serving diverse populations, and maintain version histories. Transparency builds trust, enables rights exercise, supports competition by allowing comparison, and demonstrates accountability. Modern privacy laws universally embrace transparency as essential to privacy protection.
