Preferential Treatment
Definition
Preferential treatment refers to providing different levels of service, benefits, or pricing to consumers based on their exercise of privacy rights or participation in data collection. Privacy laws generally prohibit discriminating against consumers who exercise their rights, but they allow certain forms of preferential treatment under specific circumstances. The CCPA prohibits businesses from discriminating against consumers who exercise their privacy rights by denying goods or services, charging different prices, providing different quality of service, or suggesting they'll receive inferior service. However, the CCPA permits offering financial incentives or different prices if reasonably related to the value provided by consumer data. For instance, a loyalty program that offers discounts in exchange for data collection is allowed if the benefit is proportional to the data's value. The key test is whether the preferential treatment is a legitimate financial incentive or unlawful discrimination. The GDPR doesn't explicitly address preferential treatment but requires that consent be freely given—conditioning service on consent that's not necessary for the service would invalidate consent. Organizations offering preferential treatment must clearly explain the terms, allow consumers to opt-in voluntarily, ensure the benefit is reasonably related to data value, and not penalize those who decline.
